Federal Court rejects Arbitron attempt to block NY AG action.

The federal district court in New York today rejected Arbitron’s attempt to block New York Attorney General Andrew Cuomo’s pending state lawsuit against Arbitron. The Attorney General’s pending state lawsuit charges Arbitron with fraudulent and deceptive business practices and civil rights violations in connection with Arbitron’s “PPM” (Portable People Meter) ratings system in New York, a ratings system which has been denied accreditation by the Media Ratings Council. A copy of the court’s opinion is attached. United States District Judge Denise Cote explained that the Attorney General’s state court lawsuit against Arbitron raises “important state interests” in light of the Attorney General’s charges of fraudulent and deceptive business practices and civil rights violations by Arbitron. (page 12) The federal court dismissed Arbitron’s lawsuit. The federal court allowed the Attorney General’s state lawsuit against Arbitron to proceed.
